Withdrawal & refunds

This notice provides information, on the basis of Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, about the right of withdrawal applicable to purchases from Winmax Kft. (hereinafter: Service Provider) and about the refund procedure.

1. Right of withdrawal

A Customer qualifying as a consumer is entitled to withdraw from the contract, without giving reasons, within 14 daysof receiving the product. The Customer may also exercise the right of withdrawal between the date of conclusion of the contract and the date of receipt of the product.

If several products are ordered and they are delivered at different times, the withdrawal period is counted from the receipt of the last product delivered.

2. How to exercise the right of withdrawal

The Customer may notify the Service Provider of their intention to withdraw by a clear statement using one of the following contact details:

The Customer may exercise the right of withdrawal using the withdrawal form below or by another clear statement. The deadline is considered met if the Customer sends the withdrawal statement to the Service Provider before the 14-day period expires.

3. Returning the product

In case of withdrawal, the Customer must return the product or hand it over to the Service Provider without undue delay, but within 14 days of communicating the withdrawal at the latest. The return is considered timely if the Customer sends the product before the 14-day period expires.

The direct cost of returning the product is borne by the Customer. The Service Provider does not undertake to bear the cost of returning the product.

The Customer may be held liable for any diminished value of the product only if it results from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

4. Refund

The Service Provider refunds the entire amount paid by the Customer as consideration, including the shipping cost, within 14 days of receiving the withdrawal statement. The refund does not include any additional costs arising from the Customer choosing a delivery method other than the cheapest standard delivery method offered by the Service Provider.

When refunding, the Service Provider uses the same payment method as in the original transaction, unless the Customer expressly consents to another payment method. The Service Provider may withhold the refund until it has received the product back or the Customer has provided credible proof that they have sent it back – whichever is earlier.

5. Exceptions to the right of withdrawal

The Service Provider draws attention to the fact that under Section 29 of Government Decree 45/2014 (II. 26.), the Customer cannot exercise the right of withdrawal, among others, in the following cases:

  • in the case of a sealed product that cannot be returned after opening for health or hygiene reasons;
  • in the case of a product made to the Customer’s specifications or expressly at their request;
  • in the case of the sale of sealed audio or video recordings or computer software, if the Customer has opened the packaging after delivery.

6. In case of defective performance (guarantee, warranty)

If the reason for the return is not withdrawal but a defect of the product (manufacturing defect, damage), the Customer is entitled to warranty for defects, product warranty and – for products covered by the guarantee – guarantee rights. Further information on these can be found in Terms and Conditions section 9 of the Terms and Conditions. In the case of a defective product, the cost of returning it is borne by the Service Provider.
