These Terms and Conditions (hereinafter: T&C) set out the rights and obligations of the Customer (hereinafter: Customer) using the electronic commerce services provided through the winmax.hu website (hereinafter: Website) operated by Winmax Kft. (hereinafter: Service Provider). The T&C apply to every sales contract concluded through the Website.

2. Basic provisions
The language of the contract is Hungarian. Orders placed on the Website qualify as contracts concluded electronically, governed by the Civil Code, Act CVIII of 2001 on electronic commerce services, and Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses. The contract is not considered a written contract and is not filed by the Service Provider.
3. Range of products available
On the Website the Service Provider offers electronic products (televisions, monitors, tablets, car radios and related accessories) for sale. Prices are in Hungarian forints (HUF) and include value added tax. The prices shown do not include shipping costs, about which the Customer is informed on the checkout page before finalising the order.
The Service Provider reserves the right to change the prices and products published on the Website. Changes take effect when published on the Website and do not affect orders already placed. If, despite the Service Provider’s best efforts, an incorrect price is displayed, the Service Provider is not obliged to deliver the product at the incorrect price, but may offer to fulfil the order at the correct price, in light of which the Customer may withdraw from their purchase.
4. Ordering process
- The Customer places the selected product in the virtual cart by pressing the “Add to cart” button.
- The contents of the cart can be modified at any time before the purchase is finalised; the quantity of products can be changed freely and products can be removed.
- During checkout the Customer provides their shipping and billing details, then selects the shipping and payment method.
- Before submitting the order, the Customer can check the data provided and the contents of the order in the order summary.
- By clicking the “Place order” button, the Customer makes an offer involving an obligation to pay to the Service Provider.
5. Binding offer and confirmation
The Service Provider confirms receipt of the order sent by the Customer electronically (by e-mail) without delay, but within 48 hours at the latest. If the confirmation does not reach the Customer within this period, the Customer is released from the binding offer and is not obliged to accept the order. The contract between the parties is concluded upon receipt of the confirmation.

7. Delivery methods and costs
The Service Provider delivers the ordered products to the Customer by courier throughout Hungary. The Website always displays the exact delivery time and fee during checkout, before the order is finalised. The committed delivery time is at most 30 days from confirmation; the Service Provider may indicate a shorter deadline separately for each product.
8. Right of withdrawal
Under Government Decree 45/2014 (II. 26.), the consumer has a 14-day right of withdrawal without giving reasons. The detailed rules for exercising the right of withdrawal and the withdrawal form template are contained in the Withdrawal & refunds page.
9. Statutory warranty and guarantee
9.1 Warranty for defects
In case of defective performance by the Service Provider, the Customer may assert a warranty claim against the business under the rules of the Civil Code. The Customer may, at their choice, request repair or replacement, unless fulfilling the chosen claim is impossible or would cause disproportionate additional costs. If repair or replacement was not requested or could not be requested, the Customer may claim a proportionate price reduction or withdraw from the contract. The Customer may switch from one chosen warranty right to another but must bear the cost caused by the switch, unless the business gave cause for it or the switch was otherwise justified.
The Customer must notify the defect without delay after discovering it, but within two months of discovery at the latest. After the two-year limitation period from the performance of the contract, the Customer can no longer assert warranty rights.
9.2 Product warranty
In case of a defect of a movable item (product), the Customer may, at their choice, assert the right specified in section 9.1 or a product warranty claim. As a product warranty claim, the Customer may only request repair or replacement of the defective product. A product is defective if it does not meet the quality requirements in force at the time it was placed on the market or does not have the properties stated in the manufacturer’s description. The Customer may assert a product warranty claim within two years of the product being placed on the market by the manufacturer.
9.3 Guarantee
For products covered by the mandatory statutory guarantee for certain durable consumer goods, the Service Provider provides a guarantee for the period specified in the relevant legislation (Government Decree 151/2003 (IX. 22.)). The guarantee does not affect the exercise of the Customer’s statutory rights – in particular warranty for defects, product warranty and compensation.
10. Complaint handling
The Customer may submit consumer complaints regarding the product or the Service Provider’s activities at service@winmax.hu or by phone on +36 70 608 9688. Verbal complaints are investigated immediately and, where possible, remedied. The Service Provider replies to written complaints in writing within 30 days. If the complaint is rejected, the Service Provider must inform the Customer which authority or conciliation body they may turn to, depending on the nature of the complaint.
11. Other provisions
The Service Provider is entitled to amend these T&C unilaterally. The amended provisions apply to orders placed after they take effect. For matters not regulated in these T&C, Hungarian law applies, in particular the relevant provisions of Act V of 2013 on the Civil Code and Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses.
